Initial Force AS Privacy Statement

Your privacy is important to us. This privacy statement explains the personal data Initial Force processes, how it is processed, and for what purposes.

Initial Force AS offers desktop, mobile and cloud-based products to analyze and help training within a variety of sports and activities. The products are branded as Swing Catalyst or Motion Catalyst.

Please read the product-specific details in this privacy statement, which provide additional relevant information.


Personal data we collect

Initial Force AS collects data from you, through our interactions with you and through our products. You provide some of this data directly, and we get some of it by collecting data about your interactions, use, and experiences with our products. The data collected depends on the context of your interactions with Initial Force AS products and features you use.

You have choices when it comes to the technology you use and the data you share. When we ask you to provide personal data, you can decline. Many of our products require some personal data to provide you with a service. If you choose not to provide data required to provide you with a product or feature, you cannot use that product or feature. Likewise, where we need to collect personal data by law or to enter into or carry out a contract with you, and you do not provide the data, we will not be able to enter into the contract; or if this relates to an existing product you’re using, we may have to suspend or cancel it. We will notify you if this is the case at the time. Where providing the data is optional, and you choose not to share personal data, features like personalization that use such data will not work for you.


Swing Catalyst Cam app

The Swing Catalyst Cam app is a companion app that lets an iPhone act as a camera, and if enabled a microphone, for the Swing Catalyst desktop software over a local Wi-Fi or USB connection.

The app asks for access only to the iPhone camera, microphone and local network. Camera and microphone access are used to capture video and audio for use with your Swing Catalyst desktop software. Local network access is used to find and connect to your own computer running the Swing Catalyst desktop software. The app does not request location, contacts, photos, Bluetooth or other device permissions.

The live video and audio stream and the local connection data are processed on your iPhone and transmitted directly to the paired computer you choose over local Wi-Fi or USB. Initial Force AS does not collect, receive, store, view, listen to or otherwise access the live stream, the pairing codes or the local connection content, and does not collect analytics, diagnostics, crash reports or other personal data from the app. The app contains no analytics, crash-reporting or tracking SDKs. Any recordings you choose to keep on the paired computer are controlled locally by you.

The Swing Catalyst Cam app does not require a Swing Catalyst/Motion Catalyst account and does not use cloud services on the iPhone side. Pairing is performed locally using numeric codes.

The app uses DeviceKit, a software library, to identify the iPhone model for hardware compatibility and performance purposes. DeviceKit is used locally within the app and is not used for analytics, crash reporting, advertising, tracking or sending data to DeviceKit or any other third party.

Where this local, app-side processing is processing of personal data for which Initial Force AS is responsible, we rely on Article 6(1)(b) GDPR to provide the app functionality you request and on Article 6(1)(f) GDPR for our legitimate interests in device compatibility, reliability and secure local pairing. You can disable camera, microphone or local-network access in iOS Settings; doing so may prevent the app from working. If you later upload or sync recordings through the Swing Catalyst desktop software, the Swing Catalyst/Motion Catalyst App or the Online Cloud, that later processing is covered by the relevant parts of this privacy statement.


How we use personal data

Initial Force AS uses personal data to provide, maintain, secure and improve the products and services you use, to communicate with you, to provide support, to meet our legal obligations and to operate our business. Personal account information provided by you, such as name, address and contact information, will be used to deliver the service(s) you signed up for and for related administration and support. The legal bases include performance of our agreement with you, compliance with legal obligations, our legitimate interests in operating, securing, improving and developing our products and services, and consent where we ask for it or where applicable law requires it.

We do not share personal information with companies, organizations or individuals outside Initial Force AS unless you have consented, the sharing is necessary with service providers acting as our processors on our instructions, or the sharing is required for legal reasons. Where we rely on our legitimate interests — including for internal statistics and product improvement — you can object at any time by contacting [email protected], and we will stop unless we have compelling legitimate grounds to continue or need the data to establish, exercise or defend legal claims. We do not use your data to make decisions about you by solely automated means that produce legal or similarly significant effects (Article 22 GDPR).


Using recordings to improve our products (research and development)

In addition to providing the coaching and analysis service, we use some of the video and sensor recordings and the related performance data to improve our products, including the machine-learning models behind them — this is first-party product improvement, not third-party AI training or data resale. Today, recordings enter this research only through the data-sharing setting in the Swing Catalyst desktop software, where that setting is available; our web and mobile products do not share recordings for research. Taking part is optional, and declining does not affect your use of the products. This does not include video or audio processed only locally by the Swing Catalyst Cam app, unless that data is later uploaded to or shared with us through another Swing Catalyst/Motion Catalyst product or service.

Our legal basis depends on how your recordings reached us. If you hold the account and switched the data-sharing setting on, the basis for our use of your recordings is your consent (Article 6(1)(a) GDPR); you can withdraw it at any time (Article 7(3)) by switching the setting off or emailing [email protected], and withdrawal does not affect processing carried out before it. If a coach, club or academy recorded you, we received your data from them rather than directly from you, and the basis is our legitimate interest (Article 6(1)(f) GDPR) in improving the same products that were used to record you; you have the right to object at any time (Article 21 GDPR), and we will stop using your data for this research unless we have compelling legitimate grounds to continue.

Before the data is used for research we remove names and email addresses and replace remaining identifiers with pseudonyms; we use it to analyze how a body moves, not to identify you, and not to make automated decisions that produce legal or similarly significant effects about you (Article 22 GDPR). The video itself is not face-blurred, so someone who knows you could still recognize you in it — pseudonymization removes your details, not your appearance. The data is stored and processed in Microsoft Azure (West Europe region, within the EEA). Where a project requires it, a pseudonymized subset is shared with a university research partner in the European Economic Area (EEA), only under written terms that require the partner to act on our documented instructions and prohibit re-identifying anyone, using the data for its own purposes, or sharing it; we will tell you the specific partner on request. This research stays within the EEA. We keep the data no longer than necessary for the research project it supports, and our written terms require our research partner to delete the data when the project ends.

You can ask us to access, correct, erase or restrict your data — or, where the basis is your consent, to receive the data you provided in a machine-readable format (Article 20 GDPR) — by emailing [email protected]; you can also complain to the Norwegian Data Protection Authority (Datatilsynet, www.datatilsynet.no). Switching the data-sharing setting off stops new data being added; to remove data already collected, ask us to erase it. One limitation: once data has helped train a machine-learning model, that model cannot generally be made to “unlearn” it, although we stop further use and delete the recordings and features we hold for research.


How to access and control your personal data

You can also make choices about the collection and use of your data by Initial Force. You can control your personal data that Initial Force AS has obtained, and exercise your data protection rights, by contacting us. In some cases, your ability to access or control your personal data will be limited, as required or permitted by applicable law. How you can access or control your personal data will also depend on which products you use. For example, you can: Choose whether you wish to receive promotional emails from Initial Force AS (e.g. Swing Catalyst newsletter). Access and clear some data through your Online account. If you want to access or control personal data processed by Initial Force AS that is not available via the tools above or directly through the products you use, you can always contact us on [email protected].


Data Deletion

You have the right to delete the data we have stored in connection to your account at any time. To do so, please log into your online account and go to the 'Account Settings' section in 'Edit Profile'. In this section, you can select 'I would like to delete my account and all information about me' and confirm the message. This will result in deleting all personal data associated with your Online account.


Third-party services

Swing Catalyst/Motion Catalyst integrates with YouTube API Services for select features which require giving the desktop software permission to use your YouTube account. You can at any time revoke the desktop software's access to your data via the Google Security Settings page at https://security.google.com/settings/security/permissions


Cookies

The Law states that we can store cookies on your device if they are strictly necessary for the operation of our sites. For all other types of cookies, we need your permission. Our sites use different types of cookies. Some cookies are placed by third party services that appear on our pages. You can at any time change or withdraw your consent from the cookie declaration below.


Swing Catalyst/Motion Catalyst account

An account is needed to sign in to products such as the App or the Online Cloud. To access the Online cloud in the desktop software you also need to use your account.

Personal data associated with your account includes credentials, name and contact data, device and usage data, your contacts and information about your activities.


Data Protection Officer

Initial Force AS, Stiklestadveien 1, 7041 Trondheim, Norway (org.nr. 990 340 048), is the controller responsible for the processing described in this privacy statement. We have appointed a Data Protection Officer (DPO). You can contact our DPO by email at [email protected] for any questions about how we process your personal data or to exercise your data protection rights.


Data Retention

When you request deletion of your account, your personal data will be permanently deleted within 30 days. During this period, your account will be deactivated and your data will not be accessible or used for any purpose.


Right to Lodge a Complaint

If you believe that our processing of your personal data infringes data protection laws, you have the right to lodge a complaint with a supervisory authority. In Norway, the supervisory authority is Datatilsynet (The Norwegian Data Protection Authority). You can contact Datatilsynet at www.datatilsynet.no.
